WELLFLEET CONSERVATION COMMISSION

MINUTES OF MEETING OF MAY 21, 2003, 4:00 P.M., SENIOR CENTER

Present:  Paul Banner, Co-Chair; Cyndi Moe, Co-Chair;
         John DiBlasio, Dorothy Dolan, Virginia Page,
         Edwin Reynolds; Emily Beebe, Conservation Agent;
         Erik Mitchell, Assistant; Birgitta Olson, Clerk.

Meeting called to order at 4:05 p.m. by Chair Cyndi Moe.


Business Meeting.
-  Work done by Michael Shannon, East Main Street has been stopped
  until the proper filing has been done.  John DiBlasio MOVED
   "that the Conservation require a Notice of Intent to be filed,
  and double fees mandated for the after-the-fact filing."
  SECONDED by Ginie Page and CARRIED 6-0.
-  A Conservation Restriction was signed for the Ira Ziering
  property, Pilgrim Spring Road.
-  Robert Prescott reports that piping plovers are nesting at        FielD Point.  He would like to mark the area.  The leash law      will be applied to shellfishermen's dogs.
-  A Jurisdictional Opinion Form was reviewed by Commissioners.
  This is to be used in the office by the Agent in answer to
  inquiries as to whether a filing should be made or not. There
  are still some things to be added.
-  A representative from the Division of MArine Fisheries will
  meet with Herring Warden Jeff Hughes, Emily Beebe and Erik
  Mitchell to discuss the Herring River salt marsh restoration
  project.  It was agreed that the Commission should send a
  letter to Selectmen keeping them informed of the work on the
  project.  Dottie Dolan MOVED "that the Conservation Commission    endorse the Herring River Salt Marsh Restoration Project."
  SECONDED by John DiBlasio and CARRIED 5-0-1.  John DiBlasio
  MOVED "that the Conservation Commission send a letter regarding    the project to Selectmen."  SECONDED by Ed Reynolds and CARRIED
  6-0.  Emily Beebe will write this letter.


5:00. Warren Woods, RDA, 150 Third Street, Lieutenant Island,
Map 40, Lot 98: Install snowfencing.  Joann Woods said they had discussed putting in fencing to protect the dune with Erik Mitchell, but had not realized they had to file for it.  The fencing will prevent boats and other beach paraphernalia from being left on the dune and causing erosion.  They would also like to install fencing along the top of the dune to inhibit foot traffic. It was agreed that the latter would require filing of a Notice of Intent.  Dottie Dolan MOVED "that the Conservation Commission make a Determination of Applicability, Negative #3, subject to the condition that the fencing end 15 feet back from the top of the bank."  SECONDED by Paul BAnner and CARRIED 6-0.

5:20. Betty Stride, RDA, 30 Ione Road, Map 28, Lot 60: Replace deck.  Betty Stride said she wants to replace the deck exactly as it is now.  Commissioners asked about trees taken down in front of the house.  Ms. Stride said she does not know who did it.  It was agreed that the thickly piled debris should be cleaned up to prevent erosion, and the boards placed at the foot of the bank removed. Paul Banner MOVED that the Conservation Commission made a Determination of Applicability, Negative #3."  SECONDED by Dottie Dolan and CARRIED 6-0.

5:30. Allen & Jane Curren, RDA, 110 West Main Street, Map 14,
Lot 35: Replace deck.  The plan is to replace the deck using sono tubes; build steps; and replace the terrace and the retaining wall. John DiBlasio MOVED "that the Conservation Commission make a Determination of Applicability, Negative #3."  SECONDED by Dottie Dolan and CARRIED 6-0.

5:45. Lillian & Stephen Greenberg, RDA, 50 Anawan Road, Map 24,
Lot 39: Addition & renovation.  Joy Cumming presented the plan
for a driveway to be pitched so that drainage is away from the resource and into a stone drain.  John DiBlasio MOVED "that the Conservation Commission make a Determination of Applicability, Negative #3."  SECONDED by Ginie Page and CARRIED 6-0.  

6:05. Kathryn Weill, NOI, 250 Valley Road, Map 9, Lot 615:
Repair stone patio & boardwalk; construct wood decks, landing & shower; landscaping. (Continued from 5/7/03).  Erik Mitchell said Natural Heritage has not responded, but the time is up.  Ed Reynolds MOVED "that the Conservation Commission approve the Land Design Associates Plan dated 4/13/03, subject to conditions specified."  SECONDED by Ginie Page and CARRIED 6-0.  Conditions were set.  Supervisor: Ginie Page.

6:15. Town of Wellfleet, NOI, Lot 114 Kendrick Avenue, Map 21:
Marina rehabilitation. (Postponed from 4/16/03 & 5/7/03.)  Since the Construction Protocol has not yet been received, the hearing was continued to 6/18/03.  MOVED by Dolan, SECONDED by Banner, and CARRIED 6-0.

Other Business.
-  The Minutes of the meeting of 5/7/03 were approved as amended,
  as MOVED by DiBlasio, SECONDED by Page and CARRIED 6-0.
-  Mail was reviewed.
